Terms & Conditions - the basics

By engaging BlueKey Vacancy Marketing (“BlueKey”), you agree to the following terms and conditions governing vacancy marketing and renter lead delivery services.

1. Scope of Services

BlueKey provides vacancy marketing and renter lead delivery services to property managers and property owners. Services are limited to generating renter interest, basic pre-screening, and delivery of renter contact information.

BlueKey does not:

  • Lease or show rental units

  • Schedule or attend tours

  • Negotiate rental terms

  • Approve or deny applications

  • Represent renters or property owners in leasing decisions

All leasing activities remain the sole responsibility of the property manager or owner.

2. Lead Delivery

A renter lead is considered delivered when renter contact information and basic qualification details are provided to the client via email, form submission, or other agreed-upon method.

BlueKey does not guarantee renter response, tenant approval, lease execution, or occupancy.

3. Fees & Payment

All services are offered on a flat-fee basis unless otherwise agreed in writing. Fees are due as outlined in the applicable invoice or agreement.

Payment is required regardless of leasing outcome.

4. Refund Policy

All fees are non-refundable once a renter lead has been delivered. Refunds or credits for duplicate or invalid leads may be issued at BlueKey’s discretion. Full details are outlined in the Refund Policy.

5. No Guarantee of Results

BlueKey does not guarantee:

  • Lease signing

  • Tenant approval

  • Occupancy rates

  • Rental income

Marketing and lead delivery outcomes may vary based on market conditions, pricing, availability, and property-specific factors.

6. Client Responsibilities

Clients are responsible for:

  • Providing accurate property information

  • Handling all renter communications after lead delivery

  • Conducting tours, applications, screenings, and approvals

  • Complying with all local, state, and federal housing laws

7. Fair Housing Compliance

Clients agree to comply with all applicable Fair Housing laws. BlueKey does not engage in discriminatory practices and does not participate in tenant selection.

8. Limitation of Liability

BlueKey shall not be held liable for lost revenue, missed leasing opportunities, tenant behavior, or leasing outcomes resulting from lead delivery services.

9. Service Modifications

BlueKey reserves the right to modify services, pricing, or delivery methods with notice, except where restricted by a written agreement.

Termination

Either party may discontinue services in accordance with the applicable agreement. Fees for services already rendered remain due and non-refundable.

These Terms & Conditions are governed by the laws of the State of Texas.

Acceptance

Use of BlueKey Vacancy Marketing services constitutes acceptance of these Terms & Conditions.
